Travel

General advice concerning passports and entry visas is available on the Worldaway Learning Tours FAQ’s page. Should Worldaway Learning Tours provide any suggestions and advice on travel documentation, this is purely indicative only and clients are solely responsible for having the correct and necessary travel documents that they require for their travels and to carry them while travelling. Worldaway Learning Tours does not make entry visa arrangements on behalf of clients or provide any documentation to support such. If the client chooses to obtain an entry visa ‘on arrival’ for those countries that allow this process, Worldaway Learning Tours is not liable in any respect if, for whatever reason, the client is refused said visa and cannot enter the country and continue their travel plans.

Insurance

Worldaway Learning Tours does not provide the client with insurance of any kind. Furthermore, comprehensive travel insurance is mandatory for all clients, on all Worldaway Learning Tours. Accordingly, the client is solely responsible for deciding the type, extent, and level of any insurance they require during the entire planned travel period and is solely responsible for organizing and covering the costs of this insurance.

Health

Clients are responsible for checking and confirming the immunizations and/or vaccinations required for their specific location of travel, for obtaining such, and for covering any costs incurred. Should Worldaway Learning Tours make any suggestions and provide advice on immunizations this is for indicative purposes only. Worldaway Learning Tours strongly recommend that clients visit their health professional at least eight weeks before traveling abroad as some vaccinations can take several weeks to take effect.

Tour Fees

Details of Tour Fees, including what expenses are covered and what expenses are not covered, are provided on each Tour Page. All Tour Fees are provided on a ‘Twin-share’ bases unless otherwise stated. ‘Single-occupancy’ supplement rates are provided on each Tour page where these are available. Group discounts are available in some cases and are provided at the sole discretion of Worldaway Learning Tours. Tour Fees are subject to change. Any changes made to listed Tour Fees will not affect those clients who have already confirmed their booking by paying the Deposit Fee.

Payment Terms

All bookings attract an initial Deposit fee of US$499, which is due at the time of booking confirmation. The Deposit Fee is part of and included in the listed Tour Fee. No bookings can be confirmed until the deposit fee has been received. All outstanding Tour Fees will be due in full no later than six (6) weeks prior to the clients Tour Start Date (TSD). If the booking is made within six (6) weeks of the TSD, payment is due immediately upon the date the client’s booking has been confirmed. Failure to complete this payment may result in the cancellation of the Tour Booking, at the sole discretion of Worldaway Learning Tours.

Cancellations & Refund Policy

Worldaway Learning Tours acknowledges that from time to time travel plans do change and we have therefore endeavoured to provide policies and procedures that balance the interests of our clients with the needs of our business. Considering this, all payments made to Worldaway Learning Tours are subject to the following policies:

Deposit Fees – Deposit Fees are refundable up to six (6) weeks prior to the Tour Start Date (TSD). Deposit Fees become 100% non-refundable less than six (6) weeks to the TSD.

Tour Fees – As per the Payment Terms detailed above, the remaining Tour Fee are due six (6) weeks prior to the TSD. These Fees are subject to the following refund schedule:

  • Cancellation made more than 30 days from the TSD = 100% refund
  • Cancellation made less than 30 days, but more than 14 days = 50% refund
  • Cancellation made less than 14 days from booking start date = No refund

Once the Tour starts, there shall be no refunds, either full or partial, for any reason, except if deemed warranted by Worldaway Learning Tours and at Worldaway’s sole discretion, in accordance with the Worldaway Learning Tours Complaints Policy.

All refunds incur an administration cost of $100, which is deducted from the refund amount.

Booking Changes

Any booking changes requested by the client after the Tour has been confirmed will incur a change fee of $100. This includes changing the Tour, or the Location, or the Start Date, but does not include requesting available upgrade.

Payment Defaults & Remedies

The client agrees to be responsible for any payment made to Worldaway Learning Tours that is held up or becomes defaulted, and in which any late charges or default fees become attached. In addition, if a payment made by the client is in error and reversed, the client shall be responsible to Worldaway Learning Tours for any error charges processing the bad payment. Furthermore, should a payment become defaulted at any time, Worldaway has the right to cease any client bookings, at Worldaway’s sole discretion.

Electronic Communications

When you visit the Worldaway Learning Tours site (www.worldawaytours.com) or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Privacy

The security of our client’s personal information is important to us. Worldaway Learning Tours follows generally accepted industry standards to protect any personal information submitted to us. For more details, please review our ‘Privacy Policy’.

Personal Risk

The client acknowledges and accepts the responsibilities and risks associated with their choice to undertake a Learning Tour in a foreign country. Like any travel abroad, such travel can be hazardous and involves a certain degree of personal risk, inherently dangerous activities and personal perils to the client, both foreseen and unforeseen, all of which are fully accepted by and solely assumed by the client. Therefore, Worldaway Learning Tours, including any and all of its employees, managers, directors, shareholders and independent local teams, is not liable, to the maximum extent of the law, for any loss or harm the client or associates may suffer, including but not limited to loss caused directly or indirectly by:

  • Personal or emotional injury;
  • Illness or disease or death;
  • Damage to or loss of property;
  • Natural disasters;
  • Hostage situations; or
  • War or terrorism.

Code of Conduct & Local Rules

The client agrees that Worldaway Learning Tours shall not be responsible or liable for any client who contravenes any local law or regulation of any country visited.

The client agrees to comply with the Worldaway Learning Tours Code of Conduct. Clients must read this Code before taking part in any Tour. If the client does not follow the Code, they can be removed from the project at any time and without refund. The client must also abide by any additional rules put in place by Worldaway Learning Tours’ local Tour Supplier. Contravention of these rules may result in expulsion from the Tour with no refund.

Illegal drug use is strictly prohibited and will result in instant dismissal from the program with no refund. The use of alcohol is governed by the local law or regulation of any country visited. Worldaway Learning Tours or its local tour Supplier is not responsible for controlling or monitoring alcohol consumption of Tour participants.

Indemnification

The client agrees to indemnify and hold harmless Worldaway Learning Tours and it’s independent local Suppliers from and against all damages, claims, demands, liabilities, costs, and expenses, including reasonable attorneys’ fees, resulting directly or indirectly from any violation of these terms or applicable law while undertaking or in connection with any Worldaway Learning Tours product.

Force Majeure

The client agrees that Worldaway Learning Tours shall not be responsible to pay any compensation where the performance or prompt performance of Worldaway Learning Tours or our local Supplier networks obligations is prevented or affected by reasons or circumstances amounting to ‘force majeure’. Circumstances amounting to ‘force majeure’ include any event which we or the Tour Supplier in question could not, even with all due care, avoid such as, without limitation, plane delays, war or threat of war, civil strife, government intervention, natural or nuclear disaster, industrial dispute, terrorist activity, adverse weather conditions, fire, and/or similar events.

Governing Law

These Terms and Conditions and the service provided pursuant to these Terms and Conditions will be governed by the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the New Zealand courts.

General Provisions

Worldaway Learning Tours reserves the right to make change these Terms from time to time.

Worldaway Learning Tours also reserves the right to modify the site and/or information provided at any time without notice.

Continued use of the site and/or its services following posting of any such changes will indicate the clients acknowledgment of such changes and satisfaction with the Information as so modified.

If any provision (or portion thereof) of these Terms and Conditions is declared by an arbitrator, mediator, or court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and, as far as possible, the arbitrator, mediator, or court shall limit the scope or application of the affected clause to the least extent possible in order that it may be valid and enforceable.
